Building & Zoning
The Building and Zoning Department is responsible for overseeing community development, maintaining the Land Use and Thoroughfare Plan, participation in the local Metropolitan Planning Organization and maintaining the City’s Geographic Information Systems (GIS). The department is also responsible for the review and approval of development plans, for the issuance of zoning permits, general inspections for compliance and enforcement of zoning and utility ordinances and for complaint investigation and resolution.

Building & Zoning - Development Regulations
The provisions of the development regulations were made with reasonable consideration, among other things, of the character of the city, with a view of conserving the value of the buildings placed upon the land, providing the best possible environment for human habitation, and encouraging the most appropriate use of land throughout the City.
The Heath Planning Commission administers these regulations and meets on the fourth Thursday of each month.
Any development, which requires any of the following revisions or changes to the site, shall be governed by these development regulations:
1. New building;
2. New access point;
3. If changing the impervious area by more than 10%;
4. Increasing the size of the existing building roof area by more that 10% or 1,000 sq.ft., whichever is less;
5. Change of parking lot configuration; or
6. Exterior remodeling affecting more than 10% of the building.

Do I need a permit?
Any items listed on the fee schedule is subject to the permit process.
A permit is also required for any excavation, demolition, or construction of a building, structure, or land in the City.
If you plan any activity that is not exempted, you are required to apply for a zoning permit at the Municipal Building at 1287 Hebron Rd.
The Board of Zoning and Building Appeals considers all applications for variances on a monthly basis. Meetings are held on the third (3rd) Tuesday of every month. Applications must be received before the last day of the previous month.
City of Heath Planning Commission considers all matters concerning lot splits and plan approvals. Meetings are held on the fourth (4th) Thursday of each month. Requests must be received by the Community & Economic Development Department at least two (2) weeks before the meeting.

Floodplain Management
The City of Heath has special flood hazard areas that are subject to periodic inundation which may result in loss of life and property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures for flood protection and relief, and impairment of the tax base. Additionally, structures that are inadequately elevated, flood proofed, or otherwise protected room flood damage also contribute to the flood loss. Article XVIII, Section 3, of the Ohio Constitution grants municipalities the legal authority to adopt land use and control measures for promoting the health, safety, and general welfare of its citizens.
Applications for a Flood Hazard Area Development Permit can be obtained from the Heath Zoning Department Monday through Friday between the hours of 8 a.m. and 4:30 p.m. Upon receipt of the application and all necessary documentation, the Zoning Department will determine compliance with the National Floodplain Insurance Program (NFIP) and city regulations and notify the applicant of the decision.

Stormwater Management
The Federal Water Pollution Control Act and the Ohio Water Pollution Control Act (ORC Chapter 6111) set forth the requirements for small Municipal Separate Storm Sewer Systems (MS4’s) to control and improve water quality. An MS4 is defined as a municipal separate storm sewer system that includes all conveyances of stormwater including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains.
In compliance with the provisions set forth in the Federal Water Pollution Control Act and the Ohio Water Pollution Control Act, the City of Heath is authorized by the Ohio EPA to discharge stormwater from our Small Municipal Separate Storm Sewer System to the Waters of the United States as outlined in the City of Heath's NPDES (National Pollutant Discharge Elimination System) Permit. As a permit holder, the City of Heath has established a stormwater management plan addressing five critical areas of stormwater management determined by the Ohio EPA: Public Education, Public Involvement, Illicit Discharge Detection and Elimination, Construction Runoff and Post Construction Runoff. It is our job to enforce the standards set forth in our Stormwater Management Plan and Design Regulations. The City of Heath Charter gives the City full authority to control the stormwater issues of concern in this plan.
